Homeowners Insurance Does Not Cover Home Based Daycare Services

In January 2012, the Georgia Court of Appeals found that a home-based after school daycare had no home owner's insurance for an injury to a child being cared for at the home.  State Farm v. Bauman, 01-13-12.  This is typical.  Home owner's insurance policies specifically exclude daycare operations within a home.  This includes regular baby-sitting services for after school care.  This means, even if you drop your child off with a friend or baby sitter who watches your child on a regular basis for pay, then their home owner's insurance may not cover this.  The two keys to this are 1) are you paying for the service, and 2) do they watch your child on a regular schedule.  If you have a child in a home-based daycare, ask the director or home owner if they have told their insurance agent about the business being operated out fo the home, and ask if they obtained separate coverage for the business.  Otherwise, if your child is hurt on the property through the negligence of the home owner or anyone working for the home owner, there is likely no coverage for this loss.  That means you are either on your own or left with the option of asking the home owner to come out of pocket to help you with the medical bills.
