Georgia Daycare Center Injuries on the Rise

Injuries to children in Georgia daycare centers seems to be on the rise.  A recent news piece indicated that a study found there have been over 500 major incidents at Georgia child care centers.

Of these 500 incidents, 239 involved injury to the child and 8 resulted in death. To me, the most troubling finding of this study is that the Georgia regulatory agency, which is responsible for the oversight of this industry, merely issued fines in almost everyone of these incidents. This is consistent with my own experience. Recently, I represented the family of a child who was sexually assaulted by an older child while at the daycare and the state agency found the daycare had violated various rules and regulations related to the assault. The agency issued a typical fine, $299. The daycare owner refused to pay the fine and never challenged the findings of the agency. You would think that the state agency would close the center down for failing to pay the fine and address the violations. I asked representatives at the state agency if they would be suspending the child care centers license until they paid, at the very least. The agency did nothing. The family and I were very frustrated. Fortunately, the family and I are proceeding against this child care center civilly to hold them responsible for the abuse of this child.
