Homeowners Insurance Does Not Cover Home Based Daycare Services

In January 2012, the Georgia Court of Appeals found that a home-based after school daycare had no home owner’s insurance for an injury to a child being cared for at the home.  State Farm v. Bauman, 01-13-12.  This is typical.  Home owner’s insurance policies specifically exclude daycare operations within a home.  This includes regular baby-sitting services for after school care.

The Poor State of Affairs in Georgia’s Daycare Industry

The Atlanta Journal Constitution (“AJC”) ran another article about the poor state of affairs in Georgia’s daycare industry. The AJC investigation found that 220 daycares received failing scores for at least two years in a row, and at least 200 of these centers are still open.

More Children Getting Hurt at Non-Regulated Childcare Centers

Lately more children seem to be getting hurt at non-regulated childcare centers.  Most parents believe that all daycare providers are regulated by the State of Georgia, and that the employees of those facilities are subjected to criminal background checks. While that is true of full-time regulated daycare facilities, it is often not the case with many health clubs and church “mother’s morning out” programs because they have filed for an exemption from this regulation.
